Observation Partner Terms of Service

These Terms of Service ("Terms") govern your use of the Observation Partner platform, website, and services ("Service") operated by Observation Partner ("Observation Partner," "we," "our," or "us").

By creating an account, accessing, or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Service Description

Observation Partner is an AI-assisted platform designed to help educational administrators draft observation reports based on their own notes and inputs. The Service organizes, analyzes, and structures your observation notes into a professional draft for your review and editing.

Important: Observation Partner is not affiliated with, endorsed by, or licensed by any teacher evaluation framework provider, including Danielson or Marzano. We provide general AI-assisted drafting tools only.

2. Limitations of the Service

All AI-generated reports are drafts intended to assist your workflow. You remain solely responsible for reviewing, editing, and approving any observation before submission.

We do not guarantee compliance with district, state, or national teacher evaluation requirements.

Output quality depends on the quality and clarity of your inputs. Poor or unclear notes may produce lower-quality drafts.

While we strive for high compatibility, we do not guarantee the Service will work on all browsers or devices. Certain features (including file uploads) may not function on Safari for iOS. For best results, use Chrome or Edge on a desktop or laptop.

Supported file types are .txt, .doc, and .docx only. PDF uploads are not supported.

3. User Responsibilities

When using the Service, you agree to:

Compliance. Follow all applicable laws, district policies, and privacy regulations, including FERPA.

Privacy Practices. Avoid entering personally identifiable student information (PII) unless legally required and compliant with applicable laws. We recommend using initials, first names only, or generic labels such as "Student 1."

Teacher Name Formatting. Names are only stored if entered by you. We recommend formats such as "Mrs Smith" for smoother report writing.

Content Review. Review and verify all generated observations before sharing or submitting them.

Data Backup. Maintain your own backups of important notes and reports. We are not responsible for data loss.

4. Account Rules

One account per user. Sharing accounts with multiple administrators is prohibited.

Accounts found to be shared between multiple users may be suspended or terminated to protect data privacy and FERPA compliance.

You may not attempt to reverse-engineer, bypass, hack, or misuse the Service.

You may not upload unrelated, harmful, or inappropriate content.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Harass, threaten, defame, or abuse others
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to the Service or another user's account
  • Engage in automated scraping or misuse of AI for unrelated purposes

6. Intellectual Property Rights

All software, templates, designs, and features of the Service are owned by Observation Partner and protected under copyright, trademark, and other intellectual property laws.

You retain ownership of your uploaded notes, observations, and related content.

By using the Service, you grant us a limited, non-exclusive, revocable license to process your content solely for the purpose of delivering the Service.

We may add, modify, or remove templates or features without prior notice.

7. Privacy & Data Handling

Observation Partner is designed to comply with FERPA and applicable state privacy laws.

We store only the data you provide in your raw notes and any generated drafts you choose to save.

All data is transmitted via secure encryption and stored securely.

If you avoid including student or teacher names in your raw notes, they will not be stored in our system.

8. Data Retention & Deletion

You may delete your account at any time, and all associated data will be permanently deleted from our systems with no recovery option.

Download any needed reports prior to deletion.

9. Payment & Subscription Terms

Payments are processed via our authorized payment provider, Paddle, which acts as our Merchant of Record.

If offered, your subscription may begin with a free trial. After the trial, billing will occur automatically unless canceled before the trial ends.

Subscriptions automatically renew unless canceled before the renewal date.

We do not offer refunds for unused subscription time unless required by law. Refunds, where applicable, will be processed by our authorized payment provider, Paddle, in accordance with their refund procedures.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

We do not guarantee uninterrupted service, error-free performance, or full security.

AI-generated outputs may contain inaccuracies, and you are solely responsible for verifying them.

11. Limitation of Liability

To the fullest extent permitted by law:

Observation Partner shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, arising from use of the Service.

Our total liability for any claim is limited to the total amount paid by you in the three (3) months preceding the claim.

12. Termination

We may suspend or terminate your account without prior notice if:

  • You violate these Terms
  • You share your account with unauthorized users
  • You pose a security or privacy risk
  • You engage in illegal activity using the Service

Upon termination, all associated data will be deleted.

13. Governing Law

These Terms shall be governed by and construed under the laws of the State of Connecticut, without regard to conflict of laws principles.

14. Dispute Resolution

You agree to attempt informal resolution of any dispute by contacting us before pursuing legal remedies. If unresolved, disputes shall be settled by binding arbitration or mediation in Connecticut, unless prohibited by law.

15. Changes to These Terms

We may update these Terms at any time. Significant changes will be communicated to users, and continued use of the Service constitutes acceptance of the updated Terms.
