Observation Partner Acceptable Use Policy

This Acceptable Use Policy ("AUP") forms part of the Terms of Service for Observation Partner ("Observation Partner," "we," "us," or "our"). It applies to all users of our website, application, and related services (the "Service"). By using the Service, you agree to comply with this AUP.

1. Purpose

The purpose of this AUP is to ensure that the Service is used lawfully, ethically, and in a way that protects privacy, security, and the integrity of our platform, our users, and the students and educators whose data may be entered by our customers.

2. Prohibited Activities

A. Illegal or Harmful Activities

  • Use the Service in violation of any applicable law, regulation, or government requirement, including FERPA, COPPA (if applicable), and state student privacy laws.
  • Engage in harassment, threats, discrimination, or abuse toward others.
  • Post, transmit, or store content that is defamatory, obscene, pornographic, or otherwise inappropriate in an educational or professional context.

B. Privacy and Data Misuse

  • Enter student or teacher personally identifiable information (PII) unless necessary for the intended educational purpose and allowed by your district or applicable law.
  • Share, sell, or otherwise misuse personal information obtained through the Service.
  • Upload or store sensitive personal data not necessary for observation-related purposes (e.g., health records, social security numbers).

C. Security Violations

  • Attempt to access any account or data that does not belong to you.
  • Circumvent or attempt to bypass any authentication or security measures.
  • Introduce malware, viruses, or other malicious code into the Service.
  • Interfere with, disrupt, or overload the platform or its infrastructure.

D. Platform Misuse

  • Share your account credentials or allow unauthorized access to your account.
  • Use automated tools, bots, or scraping software to access or extract data from the Service without permission.
  • Reverse-engineer, decompile, or otherwise attempt to derive the source code of the Service.

E. AI and Automation Misuse

  • Use AI-generated output from the Service for purposes unrelated to educational observation or professional evaluation without permission.
  • Attempt to re-train AI models with content from the Service for use outside your licensed account without explicit written consent.

3. District and Organizational Responsibility

  • The district is responsible for ensuring that all users under its account comply with this AUP.
  • The district must promptly deactivate accounts for staff who no longer have authorization.
  • The district must ensure that all use of student data complies with FERPA and applicable state laws.

4. Enforcement

  • Investigate any suspected violation of this AUP.
  • Remove or disable access to any content that violates this policy.
  • Suspend or terminate accounts for violations without prior notice.
  • Cooperate with law enforcement or regulatory authorities as required by law.

5. Reservation of Rights

  • Modify, suspend, or discontinue any part of the Service at any time.
  • Update this AUP at our sole discretion to reflect changes in the law, our practices, or the Service.
  • Determine, in our sole discretion, whether any conduct violates this AUP.

6. Jurisdiction and Governing Law

This AUP, and any disputes arising under it, are governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of laws principles. You agree that any dispute will be resolved exclusively in the state or federal courts located in Connecticut, and you consent to the personal jurisdiction of those courts.
